0 INTRODUCTION
Considering the safety risk and certification risk of the motorcycles, this Rules was developed to specify the general principles and requirements of implementing compulsory product certification for all motorcycles covered by its application scope, and is intended to ensure the certified products consistently comply with the requirements of applicable laws & regulations and standards.
This Rules is used together with the such general implementation rules issued by the Certification and Accreditation Administration of the People’s Republic of China (CNCA) as “Implementation Rules for Compulsory Product Certification Classified Management of Manufacturers, and Selection and Determination of Certification Mode”, “Implementation Rules for Compulsory Product Certification Utilization of Manufacturer’s Testing Resources and Other Certification Results” and “Implementation Rules for Compulsory Product Certification – General Requirements for Factory Inspection”.
Certification body shall, based on the CNCA administration characteristics and pursuant to the general implementation rules and this Rules, develop the Detailed Implementation Rules, which shall be put into effect in conjunction with the general implementation rules and this Rules.
1 APPLICATION SCOPE
This Rules applies to the motorcycles operating on highways and urban roads in China.
Considering the specific application scope and the adjustment of application scope arising from the changes in such factors as laws & regulations, applicable product standards, technologies or industry policies, the announcement issued by the State Administration for Market Regulation (CNCA) shall govern.
2 TERMS AND DEFINITIONS
The definitions of motorcycles are as specified in GB 7258 “Technical Specifications for Safety of Power-driven Vehicles Operating on Roads”; the classification of motorcycles is as specified in GB/T 15089 “Classification of power-driven trailers”.
3 REFERENCE STANDARDS FOR CERTIFICATION
Manufacturing enterprises shall fully implement the national standards and regulations concerning motorcycle safety, environmental protection, energy saving, and protection against theft, and shall fulfill their requirements.
See Appendix 1 “Reference Standards and Type Test Items” for the reference standards for certification made in accordance with this Rules.
In principle, the latest edition of the referenced standards for certification, issued by the competent authority for standardization administration, shall apply. In the case where an applicable standard is added or deleted or other standard version and its clause(s) is required, the announcement applicable to the relevant standard requirements issued by the CNCA shall apply.
Certification body shall define the year number (and clause number, where necessary) of the reference standards in the detailed implementation rules.
4 CERTIFICATION MODE
The basic mode for compulsory product certification of motorcycles is:
(1) Type Test + Enterprise Quality Assurance Capacity and Product Conformity Check (Initial Factory Inspection) + Post-certification Supervision
The quality assurance capacity and product conformity of motorcycle manufacturing enterprises shall be inspected in the manner same as the Conformity of Production (COP) check.
The post-certification supervision means one of the following three modes, i.e. post-certification follow-up inspection, sampling testing/inspection at production/port site, and market sampling testing/inspection, or any combination thereof.
(2) Type Test (Individual Homologation)
Each motorcycle shall be subjected to type test, and the relevant requirements shall be defined by the certification body in the detailed implementation rules.
Certification applicant may choose either of the above two basic certification modes to accomplish certification. Certification body shall conduct classified management of manufacturing enterprises according to the requirements of “Implementation Rules for Compulsory Product Certification Classified Management of Manufacturers, and Selection and Determination of Certification Mode for Factories”, and add certification elements by integrating with the results of classified management on the basis of the basic certification mode, to determine the appropriate certification mode to certification applicant.
